NO PURCHASE NECESSARY TO ENTER OR WIN
ELIGIBILITY: MiLB.com 2009 MINOR LEAGUE SEASON PASS is open to legal residents of the fifty (50) United States (except Rhode Island) and Washington DC who are eighteen (18) years or older at the time of entry (except in the case of legal residents of certain states or Washington DC where the age of majority is greater than eighteen (18) years of age, such age of majority). Employees, officers, and directors (including immediate family members and members of the same household) of the Professional Baseball Promotional Corp., the other NAPBL Entities (defined below), the MLB Entities (defined below) and each of their affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes are not eligible to participate. The "NAPBL Entities" shall mean National Association of Professional Baseball Leagues, Inc., each NAPBL Club, each NAPBL League, Professional Baseball Promotion Corp., Professional Baseball Umpire Corp. and all officers, directors, employees, representatives, partners, members and affiliates thereof. The "MLB Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLBAM"), SportsOnEarth, L.L.C., Tickets.com, Inc., Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. (doing business in its own name and as Major League Baseball Productions and Major League Baseball International), the Major League Baseball Clubs, and each of their subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers and employees of the above entities. The Sweepstakes is subject to all applicable federal, state, local laws and regulations. Void in Rhode Island and where prohibited by law, rule or regulation.
HOW TO ENTER: The Sweepstakes begins at 9:00 AM Eastern Time ("ET") on Friday, June 27, 2008 and ends at 5:00 PM ET on Friday, August 15, 2008 ("Entry Period"). There are two ways to enter: online, or by mail. No other method of entry will be accepted. Limit five (5) entries per person regardless of method of entry.
1. Online Method: During the Entry Period go to www.milb.com and click on the banners, buttons and/or links to access the online entry form for the MiLB.com 2009 Minor League Season Pass Sweepstakes. By submitting your complete name, date of birth, address, city, state, ZIP/postal code, telephone number, and e-mail address to MLBAM via the online entry form, you will be automatically entered in the Sweepstakes. All information submitted by entrants is subject to the MiLB.com Privacy Policy accessible at:
http://www.minorleaguebaseball.com/app/milb/info/privacy.jsp. Entrants must complete all non-optional data requested on the online entry form. Incomplete entries are void. Online entrants to the Sweepstakes will be given the option to receive commercial e-mails from milb.com and mlb.com; however, eligibility to participate in the Sweepstakes is not dependent upon entrant's consent to receive such e-mails.
2. Mail-in Method: If you do not wish to enter online, you may enter the Sweepstakes by printing your name, address, city, state and zip code, day & evening telephone number and e-mail address (optional) on a standard size postcard and mail to: MiLB.com 2009 Minor League Season Pass Sweepstakes, P.O. Box A, St. Petersburg, FL, 33731. Sponsor will only use e-mail addresses provided via the Mail-in entry method for prize notification purposes only; however, eligibility to participate in the Sweepstakes is not dependent upon entrant's provision of this information. Mail-in entries must be postmarked by Friday, August 15, 2008 and received by Sponsor by Friday, August 22, 2008. Mail-in entries become the property of the Sponsor and will not be returned.
RANDOM DRAWING: The winners of the Sweepstakes (each a "Winner" and collectively, the "Winners") will be selected by random drawing on or about Tuesday, August 26, 2008 from all eligible entries received by the Sponsor or MLBAM, as applicable. The decisions of Sponsor, including the selection of Winners, are final and binding on all matters relating to this Sweepstakes. Odds of winning depend on the total number of eligible entries received. All prizes will be awarded. Limit one prize per person, family or household.
PRIZES: Four (4) Prizes Will Be Awarded. One (1) Grand Prize Winner will receive a 2009 Minor League Baseball Courtesy Season Pass, a Minor League Baseball adjustable baseball cap and a Minor League Baseball t-shirt. The Courtesy Season Pass will admit the winner through the Gate at any 2009 regular season Minor League Baseball game except any scheduled Opening Day games. It is not to be used for admission to any League or Classification All-Star Games or post-season championship playoff games. Admission with this courtesy pass, and the number of people admitted per courtesy pass, is at the sole discretion of the Minor League Baseball club and subject to the applicable admission policies, and guidelines of the club, and/or league. It is subject to club service charge and government tax, is not transferable, and is not an admission pass to Major League Baseball ballparks or ballgames. (Estimated Retail Value of prize: $2,000.00).
Three (3) Second Place Prize Winners will receive a Minor League Baseball adjustable baseball cap and a Minor League Baseball t-shirt (Estimated Retail Value of each Second Prize: $25.00). (the "Prizes"). Each Winner is fully responsible for any and all applicable federal, state, international, local and income taxes. TRANSPORTATION NOT INCLUDED. All costs and expenses not specified herein, related to the Prize, including but not limited to lodging, transportation costs, meals, taxes (including income taxes) and gratuities and other expenses incurred by accepting the Prize are the sole responsibility of the Winner. Winner's companions must be 18 years of age or older, unless traveling with a parent or guardian.
The Prize is non-transferable and non-assignable, with no cash redemptions or substitutions except at Sponsor's sole discretion. The Sponsor, the other NAPBL Entities and the MLB Entities will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation of Minor League Baseball games. There will be no substitutions for the Prize except due to unavailability, in which case, a cash prize of equal value to the face value of the Prize will be awarded at the exclusive discretion of the Sponsor.
NOTIFICATION: Each Winner will be notified by e-mail and/or telephone by the Sponsor and/or MLBAM. In the event that the Winner does not respond to any such notification within three (3) days, a disqualification will result and an alternate Winner shall be chosen from among all remaining eligible entries. Each Winner will receive Sponsor's Affidavit of Eligibility and Release of Liability, which must be completed, notarized and returned within ten (10) days of receipt. A disqualification will result and an alternative Winner will be randomly selected from among all remaining eligible entries if the Sponsor's Affidavit of Eligibility and Release of Liability are not properly returned within the specified period of time. Refusal or return of Sponsor's Affidavit of Eligibility and Release of Liability as non-deliverable will also result in disqualification and cause an alternative Winner to be chosen from among all remaining eligible entries.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an entry, all entrants agree to be bound by these Official Rules, including all entry requirements. By entering the Sweepstakes, each Winner agrees to waive any and all claims against the Sponsor, the other NAPBL Entities, the MLB Entities and each of their respective agents and representatives for any injury, damage or loss that may occur from the participation in the Sweepstakes or from the receipt or use of any prize or travel related to the receipt or use of any prize, and each Winner grants to Sponsor, the other NAPBL Entities and the MLB Entities the right to publicize such Winner's name and/or likeness in any medium without additional compensation or consideration unless prohibited by law.
GENERAL CONDITIONS: The Sponsor, the other NAPBL Entities, the MLB Entities and each of their respective agents and representatives are not responsible for printing or typographical errors in any Sweepstakes-related materials; stolen, late or misdirected entries, lost, damaged, garbled, delayed, misdirected, damaged, incomplete, postage due or illegible entries. Sweepstakes entries generated by a script, macro or other mechanical or automated means will be disqualified. The Sponsor, the other NAPBL Entities, the MLB Entities and each of their respective agents and representatives are not responsible for incorrect, inaccurate transcription or loss or delay of entry or prize reply information, or any viruses transmitted to computers of participants via the Internet, or for any technical or human errors associated with the Sweepstakes. If, in the Sponsor's exclusive judgment, this promotion becomes compromised in any way, Sponsor reserves the right to withdraw the promotion offer, cancel any method of entry, to void any entries submitted fraudulently or select Winners from all eligible entries received prior to act that compromised the promotion.
Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor, the other NAPBL Entities, the MLB Entities or their respective agents. Sponsor, the other NAPBL Entities and the MLB Entities shall have the sole right to disqualify any contestant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in their sole discretion. Sponsor, the other NAPBL Entities and the MLB Entities (i) make no warranty, guaranty or representation of any kind concerning any prize, and (ii) disclaim any implied warranty. All disputes will be resolved under applicable U.S. laws in the County of New York, state of New York.
The Sponsor, the other NAPBL Entities and the MLB Entities reserve the right, in their sole discretion, to cancel or suspend the Sweepstakes should virus, bugs, unauthorized human intervention, or other causes beyond the control of the Sponsor, the other NAPBL Entities or the MLB Entities corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes. In the event of cancellation, Sponsor may elect to identify Winners and award the prizes by way of random drawing from among all entrants who had entered the Sweepstakes at the time of such cancellations.
All online entries must include a valid e-mail address for the entrant. In case of multiple entries, only the first entry received will be considered. In the event of a dispute as to the identity or eligibility of a Winner based on an e-mail address, the winning entry will be declared made by the "Authorized Account Holder" of the e-mail address submitted at the time of the entry. The "Authorized Account Holder" is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.
WINNERS' LIST: For a list of Winners, mail a self-addressed stamped envelope to: MiLB.com 2009 Minor League Season Pass Sweepstakes, Attn: Minor League Editorial Department, MLB Advanced Media, 75 Ninth Avenue, New York, NY 10011. Winner's list requests must be made by Friday, September 19, 2008.
